\/><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">                                 Ai fini delle agevolazioni ex art. 148 del TUIR, la Cassazione, con ordinanza n. 29800 del 12.10. 2022, ha ribadito che non assume rilievo la sola regolarit\u00e0 formale, ossia l\u2019affiliazione ad una FSN-EPS o DSA e\/o le clausole statutarie conformi agli scopi istituzionali, se nel concreto il sodalizio svolge attivit\u00e0 commerciali del tutto prevalenti, se non addirittura estranee, alle finalit\u00e0 sportive istituzionali per cui si \u00e8 costituito.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pertanto i benefici dipendono non solo dalla <strong>veste giuridica assunta<\/strong>, <strong>elemento<\/strong> prettamente <strong>formale<\/strong>, ma, nel <strong>rispetto<\/strong> del principio di <strong>democraticit\u00e0<\/strong>, dall\u2019<strong>effettivo svolgimento <\/strong>di <strong>attivit\u00e0 senza<\/strong> <strong>fine di lucro<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nel caso di specie l\u2019attivit\u00e0 sportiva era circoscritta alle mountain bike mentre, in maniera decisamente prevalente, venivano svolte attivit\u00e0 del tutto estranee al mondo dello sport quali agriturismo, ristorazione e country house.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ai fini delle agevolazioni ex art.
